Imtiaz Gul, Editor in Chief, Matrix Media, met Hasan Aslam Shad, an international jurist and expert on International law in Islamabad recently. The conversation was part of the Matrix Special interview series. Hasan Aslam Shad is based in the Middle East but keenly follows regional affairs.
The conversation primarily revolved around the challenges Pakistan faces in the International community besides discussing the notion of lawfare. Imtiaz Gul asked what actually is law fair and how is it affecting Pakistan and what Pakistan needs to do more to escape the negative consequences of the lawfare by neighboring countries.
Hasan Aslam Shad explained to put it very simply, lawfare is the use of law as a weapon of war. We are all used to seeing wars being thrust on countries going to armed conflict with one another but lawfare is using law as a weapon that supplements your military capabilities so today for example countries go to war not only on the physical battlefield but they also go to war in different international forums where they fight out cases. We have a recent example in front of us where India and Pakistan fought the Kalbushan Jadhav case in which India and Pakistan made two competing sets of arguments.
The other example of lawfare is the use of international institutions against a country. So we are, as a country on the FATF grey list. Now, this is also lawfare because the American influence in the international institutions has been used against Pakistan.
